1. Operator identity
The service is operated by Jerusalem Catering. Contact: 054-983-3742. These terms apply to transactions between the operator and you as a consumer under the Israeli Consumer Protection Law, 5741-1981.
2. Nature of the transaction
Orders placed through this website constitute remote sales (מכר מרחוק) as defined in the Consumer Protection Law. You will receive order confirmation and details as required by law. Prices displayed include VAT unless otherwise stated. Delivery dates are fixed in advance for Pesach (Yom Tov and Chol Hamoed) and the dishes are prepared especially for those dates.
3. Cancellation and cooling-off rights
Our products consist of cold and frozen food dishes prepared to order for specific Pesach delivery dates and are liable to deteriorate or lose their quality if not handled and consumed as intended. Under the Consumer Protection Law and the Consumer Protection (Cancellation of Transactions) Regulations, 5771-2010, the statutory right of cancellation for remote sales generally does not apply to:
- Goods that by their nature are liable to deteriorate or expire rapidly, including prepared food and catering for a specific date.
- Goods manufactured specially for the consumer's order, or adapted to the consumer's specific requirements for a particular delivery date.
- Transactions for services or catering tied to a specific date or event, once performance has begun or where cancellation would cause an unreasonable loss not intended by the law.
Despite these legal exclusions, if in your specific case the statutory right of cancellation does apply (for example, for a transaction that is classified differently under the law), we will honor any cooling-off periods, extended periods for seniors, new immigrants, and persons with disabilities, and all other protections granted by the Consumer Protection Law. In any such case, cancellation must be made by notifying us in writing (e.g. email or message to the contact number above), and we will not charge any fees beyond what the law permits.
4. Our commercial cancellation policy
In addition to and without limiting any mandatory statutory rights, we offer the following commercial cancellation policy for Pesach food orders: you may cancel your order and receive a full refund up to 5 days before the scheduled delivery date. As we begin purchasing ingredients and preparing dishes close to the delivery date, we may charge up to 100% of the order amount for cancellations made less than 5 days before the scheduled delivery date, to cover costs already incurred.
If we are able to avoid loss (for example, by reallocating dishes to other orders), we may, at our discretion, offer a partial refund or credit even after the above deadline. Any refund that we are required by law to provide will be made within the period and by the method prescribed in the Consumer Protection Law and the applicable regulations.
5. Warranties and post-sale service
We will provide the catering services in accordance with the order and our description. Any warranty or post-sale service terms will be communicated at the time of order or in your confirmation. You retain all rights under the Consumer Protection Law regarding defective performance or non-conformity.
6. No waiver of statutory rights
Nothing in these terms is intended to waive or limit any right you have under the Consumer Protection Law or related regulations. Any provision that conflicts with mandatory law is invalid to the extent of the conflict. Terms that are more favorable to you than the law will remain in effect.
7. Complaints and authority
For complaints regarding consumer protection you may contact the Authority for Consumer Protection and Fair Trading. You may also have rights to compensation and small-claims procedures as set out in the Consumer Protection Law.
8. Changes and language
We may update these terms from time to time. The terms applicable to your order are those in effect at the time you place the order. In case of conflict between the Hebrew and English versions, the Hebrew version shall prevail to the extent required by Israeli law.
